Commercial General Liability (CGL)

A CGL policy protects you from property damage or bodily injury arising from your business operations. It includes damage or injury occurring on your premises or away from your premises and injury or damage caused by your product even after it is sold or your work is finished.

The Commercial General Liability Insurance is the basis of a good risk reduction plan and for many types of business the only form of liability insurance they may need other than automobile liability.

The CGL, like all insurance policies, contains exclusions. Some of these exclusions can be covered by separate insurance, such as professional activities, administrative duties of directors and officers, and employment practices.

Tenants’ Legal Liability

If you rent or lease your business premises, you can be legally responsible for any damage to the premises arising from your operations and occupancy of the premises. This damage is excluded from your property insurance and from your Commercial General Liability (CGL) policy. Tenant’s Legal Liability specifically covers this risk. Some insurance companies will automatically include this coverage along with their CGL policy, but don’t count on it--be sure to check that you have it.

 


Directors and Officers Liability Insurance (often called D&O)

D&O is liability insurance protecting directors and officers of a society or company against damages or defense costs in the event that they are sued for wrongful acts committed while fulfilling their role as director or officer. This coverage may be needed by your business whether you are a for-profit or non-profit organization.

Umbrella Liability

Umbrella Liability is designed to literally act like an umbrella for businesses with complex operations, multiple companies or locations. The Umbrella policy protects the owner from the possibility of coverage gaps between multiple liability policies or exclusions in coverage in the underlying liability policy. It also acts as excess or extra coverage if a catastrophic claim exceeds the primary or underlying liability policy. The Umbrella policy can also provide excess coverage for owned automobiles, watercraft and even aircraft.

 


Employment Practices Liability

If you have employees, you can be subject to litigation over actions or perceived actions as an employer. This can include, but is certainly not limited to, wrongful dismissal, failure to promote, failure to hire, discrimination, mental or sexual harassment and other claims of improper conduct that can be brought against an employer. Administrative errors in relation to EI, income tax, pension and other benefits are also included. These claims are specifically excluded under the CGL coverage but are covered by Employment Practices Liability, also referred to as EPL coverage.

Professional Liability

Professional Liability, or Errors & Omissions (E&O) Liability protects you from claims for injury or damage arising from your professional service. Your Commercial General Liability (CGL) policy will always exclude any claims arising from providing or rendering a professional service, so this coverage is needed in addition to your CGL. We can provide coverage for all professions.

If you belong to a professional association they may have arranged a special group program of professional liability for all association members. We recommend you check with your association first because this is often the least expensive way to obtain coverage. If they do not already have one, we can organize a special group program to be offered through your association.
